ARTICLE 2 – ACCEPTANCE OF THE TERMS OF USE
Any person accessing the Site is hereinafter referred to as the “User.”
By accessing and/or using the services offered by the Site, the User agrees to comply with these general terms of use (the “Terms”), which they acknowledge having fully read.
The Terms govern the relationship between the Site and the User, and the Site is accessible from various devices (computer, tablet, smartphone, etc.).

SPOA PROD reserves the right to modify the Terms at any time and unilaterally. These modifications become binding on the User as soon as they are published online. The User is responsible for regularly reviewing the Terms. By continuing to access the Site, the User is deemed to accept the latest version.

In case of the User’s non-compliance with the Terms, SPOA PROD may suspend services offered on the Site and/or deny access without notice. The Terms exclusively govern the contractual relationship between SPOA PROD and the User, excluding any other agreement.

ARTICLE 3 – SITE ACCESS
The Site is accessible 24/7, except in cases of force majeure or events beyond SPOA PROD’s control, subject to potential malfunctions or maintenance required for the proper functioning of the Site and its services.

ARTICLE 4 – DESCRIPTION OF SERVICES OFFERED BY THE SITE
The purpose of the Site is to present the activities and achievements of SPOA PROD to Users.

ARTICLE 5 – INTELLECTUAL PROPERTY
Site Content
All content on the Site (videos, photographs, graphic design, layouts, texts, logos, trademarks, software, etc.) is protected under the Intellectual Property Code and cannot be reproduced, represented, adapted, or used without the express prior consent of SPOA PROD and/or the rights holders. Unauthorized use constitutes an infringement liable to civil and/or criminal prosecution.

ARTICLE 6 – PERSONAL DATA PROTECTION
The Site allows SPOA PROD to collect certain information about the User. This data is collected in compliance with applicable laws and regulations on personal data protection to provide the User with a personalized and optimal experience on the Site.

Collected Data
When the User visits the Site, data such as page visits and anonymized IP addresses may be collected.

Data Controller
Personal data is processed by SPOA PROD directly or through an IT service provider in compliance with the French Data Protection Act No. 78-17 of January 6, 1978, amended by the Act of August 6, 2004.

Purpose of Data Collection
By providing their personal data, the User consents to its processing by SPOA PROD. This data is used for statistical purposes to improve the Site’s operation, maintenance, and security.

Recipients of the Data
The data processed by SPOA PROD may be accessed by:

Authorized personnel in marketing, sales, customer relations, administrative, logistics, and IT services, along with their managers;
Authorized personnel responsible for internal controls (auditors, internal procedure teams, etc.);

This data remains strictly confidential. SPOA PROD commits not to disclose the User's data to unauthorized third parties without their express consent.

User Rights
In accordance with the French Data Protection Act, the User has rights to access, rectify, oppose, delete, restrict processing, and port their personal data. Requests must include proof of identity and necessary details to allow SPOA PROD to respond.

ARTICLE 7 – COOKIES
When using the Site, cookies are placed on the User’s device. A cookie is a text file deposited during a site visit or advertisement viewing to collect navigation data and provide services tailored to the User’s device.

SPOA PROD uses cookies necessary for the Site’s operation, audience measurement, and interactivity enhancement (e.g., social media sharing buttons). The User can allow, refuse, or disable cookies. ARTICLE 8 – LIMITATIONS OF WARRANTY AND LIABILITY
The Site and its content are provided “as is” and subject to availability. SPOA PROD cannot be held liable for damages resulting from the Site’s unavailability and only has a best-efforts obligation. Users guarantee they have the appropriate equipment and software for safe use of the Site and the internet.

SPOA PROD does not guarantee uninterrupted Site operation or that it will be error-free. It reserves the right to withdraw the Site or its services at any time without prior notice or compensation.

ARTICLE 9 – MISCELLANEOUS PROVISIONS
These Terms are governed by French law.
In the event of a dispute, the User can contact the Site at hello@spoastudio.com to seek an amicable resolution. If no agreement is reached, the dispute will fall under the jurisdiction of the competent courts in Paris.
